Complementing its commercial litigation, commercial collections,
and other practice areas, the firm represents creditors in
bankruptcy proceedings. CIM asserts and protects the rights of
secured creditors, unsecured creditors, and financial
institutions in Chapter 7, Chapter 11, and Chapter 13 cases,
including advice and representation in:
-
Lease/contract assumption, assignment, and rejection;
- Administrative expense
claims;
- Stay relief litigation to recover collateral, proceed with
pending state court litigation, and collect damages from the
Residential Contractors’ Recovery Fund maintained by the Arizona
Registrar of Contractors;
- Plan opposition
litigation; and
- Reclamation.
In addition, CIM obtains favorable results
for its clients in the defense of preference litigation and
claim disputes with bankrupt debtors and bankruptcy trustees.
Further, based on the bankruptcy and commercial litigation
experience of its lawyers, the firm has been retained as special
counsel to a bankruptcy trustee and successfully recovered
fraudulent transfers on behalf of the bankruptcy estate. CIM
represents clients in U.S. Bankruptcy Courts in the District of
Arizona and in numerous other Districts throughout the United
States, including, for example, the Central District of
California, the District of Delaware, the Southern District of
New York, and the Western District of Virginia.
Even if a debtor appears to be headed
towards bankruptcy and has not yet filed its petition for
bankruptcy relief, our firm can provide valuable advice and
representation to its clients on how to protect their rights in
advance of a bankruptcy filing. |
