Homeowners Association (HOA) Litigation

CIM is accomplished in representing homeowners in homeowners’ association litigation.  Our attorneys are well versed in the law applicable to homeowners’ associations, including directors’ duties, assessments, HOA liens, open meetings, HOA records, CC&R enforcement, developer turnover, accounting, attorneys’ fees, and director elections.

CIM specializes in both defending homeowners in HOA initiated litigation and assisting homeowners in prosecuting claims against HOA’s.  We recognize that the costs involved in HOA disputes can be significant, and therefore make every effort to resolve disputes short of litigation.  In the event litigation becomes necessary, however, CIM is prepared to aggressively defend or prosecute the homeowner’s claims.

CIM has handled HOA disputes, both small and complex, which have been recognized by many local media outlets. Please view our "HOA in the news" section or our News page to read about CIM's continued conflicts with homeowner associations.  Steven W. Cheifetz was featured on an ABC 15 News report Controlling HOA's about their disregard for homeowners.  In it's efforts to protect homeowner's, CIM has received a published opinion in the Court of Appeals. Raimey v. Hon. J. Ditsworth et al., 2011 WL 2926811 (App. 2011), 613 Ariz. Adv. Rep. 34.
